PHOENIXVILLE — Following a three-month investigation, a Phoenixville man was arraigned on felony child pornography charges in district court Thursday morning.

Thomas James Evasew, 35, of the 500 block of West High Street, Phoenixville, is charged with 90 counts of felony child pornography possession charges, as well as one count of sexual abuse of children and criminal use of communications facility.

According to court documents, Trooper Jon Nelson of the Pennsylvania State Police Bureau of Criminal Investigation, Computer Crime Unit, said that officials became aware of Evasew during an investigation around 5 p.m. Aug. 23, 2008.

Nelson stated that Cpl. Robert Erdely of the Computer Crime Unit was conducting a proactive online investigation into the distribution of child pornography.

While online, Erdely located an individual utilizing a particular IP address and sharing child pornography via a peer-to-peer network.

A peer-to-peer network is a communication network that enables users to connect their computers and share files directly with other users without having to go through a centralized server.

One of the movies being shared was known to police, and the video depicted a 14-year-old boy engaged in sex acts with another male child, said Nelson.

"Cpl. Erdely utilized a court order to determine that the subscriber for the account of the IP address was (Evasew)," said Nelson.

In December, Nelson served a search warrant on Evasew's residence.

"During the search, I interviewed (him) and he admitted to knowingly possessing and distributing child pornography from August until December," he said.

State police seized several hard drives from Evasew's residence in December.

During a subsequent forensic analysis on the hard drives, Nelson said he found 83 images and seven movies that contained child pornography.

Evasew was escorted into the courtroom Thursday morning with his parents and his attorney, Steve Baer, for his arraignment before Magisterial District Judge Ted Michaels.

When Michaels asked Evasew if he'd ever been arrested before, Eva

sew answered, "No," but Baer informed the court that his client has two previous driving under the influence arrests from 2003.

"One was in Chester County, and the other was in Montgomery County," said Baer.

During the preliminary arraignment, Baer said that since the search warrant was executed in December, his client has been cooperative with state police.

"We contacted Trooper Nelson and arranged for his surrender today," he said. "I don't see my client as being a flight risk."

Nelson responded, "In accordance with the Chester County District Attorney's Office, their only concern was that he post some sort of bail."

Michaels said that the Chester County Bail Agency recommended a $250,000 unsecured bail, however, Michaels added some bail provisions. After a brief sidebar with Nelson and Baer, Michaels placed the bail provisions of no criminal Internet conduct, no criminal conduct, contact the bail agency, and Evasew is to not associate with any children under the age of 18.

"That means no schools or any youth groups," said Michaels sternly.

With that being said, Evasew was released on the $250,000 unsecured bail set by Michaels. ..Source.. by DENNIS J. WRIGHT
